TERMS & CONDITIONS
All work booked will be under the agreement of the Terms and Conditions (T&Cs) written here - www.markfieldphotography.com/about - unless otherwise stated or contracted. Our payment terms are 30 days.
1. Cancellation: If a project is cancelled within 24 hours before the confirmed day of production (not 24 hours from call time), the client will be charged for 75% of the fee and any Expenses incurred. If a project is cancelled within 48 hours but before 24 hours before call time, the client will be charged for 50% of the Fee and any Expenses incurred. If at any point after work has commenced on the project you choose to cancel the work you will still be liable for all Fees, Production Days and all Expenses already incurred, along with cancellation fee if applicable.
2. Late Payments: Unless otherwise specified or agreed, interest will be charged at 8% above the base rate of the Bank of England (5% as of July 2023) on all overdue balances until paid (charged daily). There will also be a late fee of £40 for my time spent chasing payment.
3. Usage, Copyright and Attribution: The final edited images from shoots shall be the Clients property and for their use only. All raw materials and data created by the the photographer over the course of the contract, including, but not limited to, film, data, and digital files, shall remain the photographers exclusive property. The raw files can only be made available if agreed before production, or will incur an extra cost. The photographer reserves the right to use finished images and video for their own promotion online unless the Client otherwise confirms in writing that the photographer cannot.
4. Storage
The photographer is not required to store the original images or footage longer than 30 days, but if requested in writing by the Client, files can be stored for an additional charge. The photographer is not liable for any loss or damage to stored material.
Editing Service / Post Production
General colour correction and formatting of images to client specifications is included in the quoted rate.
Additional requests such as object removal, skin / hair work, colour grading, things that were out of the photographers control at the time of capturing the image is charged on an hourly basis of £30 per hour.
My day rate for editing covers an 8 hour day. My working hours are 9am until 5pm or 10am until 6pm. If work is requested beyond these hours for the purpose of a client deadline, I reserve the right to charge overtime at £12.50 per hour. In the case of a tight or same day deadline, please ensure changes are provided swiftly so that I can complete the work within working hours.
The client is responsible for picking up changes and human error. Please be vigilant when checking through images.
The quoted amount of editing days is an estimate. If it takes longer to complete a project I may ask for more edit days, which will then be agreed with the client. On the other hand, if I run under the amount of days, I will let you know that it has taken less days to complete.
Unexpected amounts of changes that run over the quoted amount of days, or once a project is already signed off, are subject to a fee depending on how many changes there are - a half day, full day or a £50 one off edit fee.
Acceptance of Terms
The fees, specifications and conditions detailed above are hereby accepted. The photographer is authorised to begin work as proposed. Payment of fees will be made as indicated above.
